These Terms & Conditions (“Terms”) govern (1) your use of containexco.com (the “Site”) and (2) the purchase of products from Container Sales Co. Inc. (“Company,” “we,” “us,” “our”).

By using the Site, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or complete a purchase.

2) Scope of What We Sell

We sell industrial-grade equipment, including shipping containers (10ft, 20ft, 40ft, 45ft), refrigerated containers, flat racks, open-top containers, insulated containers, chassis, tilt-bed trailers, steel cabins, and accessories.

These products are heavy-duty assets, and buyers should expect industrial characteristics (weight, freight delivery, normal handling marks, and condition grading).

3) Quotes, Pricing, and What “Order Confirmed” Means

Quotes

Quotes are valid only for the timeframe stated in the quote. Freight markets move (fuel, carrier availability, regional capacity), so quotes may expire.

Pricing

  • Prices are listed in USD
  • Freight is typically priced separately or included as specifically stated
  • Taxes (where applicable) are calculated based on delivery destination

Order Confirmation

An order is confirmed only when:

  1. payment is received and cleared, and
  2. we verify the delivery/pickup details.

This is not red tape — it prevents costly dispatch errors on freight equipment.

4) Product Condition, Variations, and “What You’ll Actually Receive”

Condition Grading

Where applicable, products are sold under our Container Condition & Grading Guide. Cosmetic wear (scratches, dents, surface rust) is normal on used units and does not automatically indicate a defect.

Photos and Listings

  • Photos may be representative unless explicitly stated as “exact unit photos.”
  • Container condition can vary within the same grade due to prior service history.

If your project needs a very specific appearance or measurement tolerance, tell us before purchase so we can advise properly. This reduces misunderstandings and aligns with the “no surprises” standard Google expects.

5) Payment Terms and Verification

Payment methods and rules are detailed in our Payment Policy, which is incorporated into these Terms.

Because orders are high-value, we may request reasonable verification (identity confirmation, business info, delivery confirmation) to prevent fraud and misdelivery.

We reserve the right to cancel or hold an order if:

  • payment appears unauthorized or high-risk,
  • verification fails,
  • delivery details are incomplete or inconsistent.

6) Shipping, Delivery, Depot Pickup, and Access Reality

Shipping is governed by our Shipping Policy, incorporated into these Terms.

Freight Delivery Is Different From Parcel Delivery

These products ship by freight carrier. Delivery typically requires:

  • appointment scheduling,
  • adequate access for large trucks,
  • and a safe drop-off area.

Customer Responsibilities

You are responsible for:

  • ensuring the delivery site is accessible,
  • confirming offloading capability (forklift/crane/crew if needed),
  • confirming local restrictions (HOA rules, city access limits, permits if applicable).

If a carrier cannot deliver due to access limitations, re-delivery and/or storage fees may apply.

Depot Pickup

If you choose depot pickup, you are responsible for:

  • pickup scheduling within the depot’s rules,
  • having proper transport and securement for the load.

7) Delivery Inspection, Acceptance, and Damage Reporting

This section is here because it prevents most disputes.

At Delivery (or Pickup)

You must inspect the unit before signing the carrier’s delivery receipt.

  • If there is visible damage: note it clearly on the delivery paperwork and take photos.
  • If damage is severe: refuse delivery and contact us immediately.

Signing without notation typically means the shipment was received in acceptable condition.

8) Shipping Delays and Your Options

We do our best to provide realistic delivery estimates, but freight delays can occur.

We follow U.S. prompt-delivery expectations: if we can’t ship within the promised timeframe (or within a default window when no timeframe is stated), we will notify you and provide options consistent with FTC prompt delivery standards — including consent to delay or cancellation/refund for the unshipped portion as required.

We don’t use delay language as an excuse; we use it as a transparency mechanism.

9) Returns, Refunds, and Cancellations

Returns and refunds are governed by our Returns & Refunds Policy, incorporated into these Terms.

Key Reality for Heavy Equipment

Freight-shipped equipment cannot be returned like small parcels. Return eligibility depends on condition, timing, and whether the product has been used, modified, commissioned, or relocated.

Cancellations

  • If an order is canceled before dispatch, a refund may be available minus payment processing or administrative costs where applicable.
  • If freight has already been dispatched or scheduled, cancellation may not be possible or may include carrier fees.

10) Warranty and Disclaimer Framework

Warranty coverage is governed by our Warranty Policy, incorporated into these Terms.

Unless explicitly stated in writing, products are sold:

  • according to the listed condition and description,
  • with warranty limits appropriate to new vs used vs as-is inventory.

We do not promise that a container will meet a particular building code, zoning rule, or conversion requirement unless explicitly agreed in writing.

11) Risk of Loss and Transfer Points

For freight transactions, risk of loss and responsibility depend on delivery/pickup and acceptance. Pennsylvania commercial code includes rules on risk of loss where the seller is a merchant and the buyer receives the goods. 

Practically:

  • If goods are damaged before delivery, we work with carriers and insurance.
  • If goods are accepted at delivery without notation, claims may be limited.

This is why inspection is non-negotiable.

12) Chargebacks, Disputes, and Communication First

If you have any billing issue, contact us first. Most problems are solved quickly when handled directly.

Unnecessary chargebacks create delays with carriers, payment processors, and inventory allocation. If a chargeback is filed without prior communication, we reserve the right to pause support until the processor dispute process is complete.

This isn’t punishment — it’s the reality of how financial disputes freeze fulfillment pipelines.

13) Website Use Rules

You agree not to:

  • attempt to access restricted systems,
  • interfere with website operation,
  • misuse content for unlawful purposes.

We may block or restrict access when misuse is detected.

14) Intellectual Property

All text, layout, logos, and media on the Site are owned by us or licensed to us and may not be reused without permission.

15) Privacy and Security

Your use of the Site is also governed by our Privacy Policy and Security Policy, which explain how data is collected, used, and protected.

Clear, honest policies and consistent business information support customer trust and platform compliance expectations.

16) Force Majeure

We are not responsible for delays or failures caused by events outside our control (weather, carrier shutdowns, route restrictions, supply chain disruptions, governmental actions).

17) Governing Law and Venue

These Terms are governed by the laws of Pennsylvania, excluding conflict-of-law rules. Disputes will be handled in courts located in Pennsylvania unless applicable law requires otherwise.

18) Updates to These Terms

We may update these Terms from time to time. Updates will be posted with a revised “Last Updated” date. Continued use of the Site after an update constitutes acceptance.
